That's true, but our courts and our government as a whole also abide by a set of implied powers and legal precedence that have? been established over the course of our nation's history. Unless you're a strict constitutionalist, or just a fucking idiot who doesn't know any better, it's not as simple as "it is/isn't in the constitution, therefore it must/must not be constitutional."

Hey booley, I think I should say something here after so long a time commenting back and forth that I realize we are left/right or on different sides of issues but I learned a few things reading your comments and changed my thinking a little bit. I havent' listened again but I think that was Sam paraphasing the Judge. And as far as the constitution, it also does not say that my girlfriend can abort my child without telling me. But some judge said it's ok. So your sincerety is good but not all that convincing in? the world we live in. I wish it were though.

And considering the 14 amendment where everyone is suppose do have the same rights when under the jurisdiction of the US (even non-citizens) that is not an unreasonable argument to make.
